Same here. Anyway if you're smart you would have adequate legal asset protection strategies in place.....just in case.

Smart?

Would 5 million dollars in the bank be sufficient assets to defend yourself legally? If you're up against the RIAA or any large organization your pockets will never be sufficiently deep. I don't care if you get David Boise to defend you pro bono, you will probably not win the case. Such is the legal system, most of the time: He with the most cash almost always wins the case.

(There are exceptions if you can call it an exception. I cheered when the  government lost the case on the "culling" rights to logs in a forest recently against when the EPA (another government department) called their bluff)

Surely BK there are legal  things you can do in the US, so that if you ever get sued AND lose.....you technically have no assets that can be liquidated.

Having your assets in your spouse's name for example.

Cheers,

I believe I'd rather take my chances getting sued by the RIAA.  Shocked

Putting your life's savings and gear in your future ex-wife's hands?

Take an aspirin, get some rest, drink plenty of fluids, and if you don't feel better in the morning, Tony, call me.   Laughing

A number of studios, engineers and seconds have learned this lesson the hard way. It all comes down to using common sense.

Could you cite some of these cases or provide links?

Yes, please.

This was all over the trades 5 to 10 years ago. I couldn't find anything in Google and I don't have time to follow up.  SPARS probably has some detailed information.

AFAIK the onus is on the one ordering the replication.  You MUST have all of the paperwork in place and fees paid PRIOR to having CD's replicated at any manufacturing plant in the country that is on the RIAA radar.

But, in order to CYA you should have a form that the client signs that specifically states that THE CLIENT is responsible for that end of things.

Best regards.
