It's part of the Gnu Public License, so it's free and always will be. As far as I know, the codecs are stable as of now and work very well. A direct comparison to mp3 isn't completely fair, because a flac-encoded file will be four to five times larger than an equivalent mp3. I also noticed on the flac site that Apple has its own proprietary lossless audio format, so chance are that's what Apple is going to throw their complete support behind. But I'm a big fan of the GPL and I really hope that flac will catch on.
